The regulatory structure:

High-risk AI classification (HR-adjacent): These trigger mandatory consultation:

  • Recruitment scoring or resume screening
  • Performance assessment or promotion recommendations
  • Qualification evaluation affecting employment decisions
  • Sales territory allocation
  • Compensation/commission calculation
  • Customer segmentation with employment implications

Planning timeline (must reserve 4–8 weeks before rollout):

Weeks 1–2: Works council notification
- Formal written notice of AI introduction
- Technical documentation: how the tool works, decision logic
- Impact assessment: what jobs/roles affected, what data used

Weeks 2–4: Consultation process
- Works council meets, gathers employee input
- External expert review (Germany, some others)
- Negotiation of safeguards, audit rights, data handling

Weeks 4–6: Remediation
- Adjust system based on feedback
- Document agreed safeguards
- Build monitoring/transparency mechanisms
- Employee communication plan

Weeks 6–8: Implementation
- Final approval sign-off
- Deploy with agreed controls
- Ongoing reporting to works council
